- California AG Rob Bonta, along with three other states and the District of Columbia, filed an amicus letter expressing concerns with 3M’s revised proposed class action settlement with public water suppliers to remediate the per- and polyfluoroalkyl substances (PFAS) contamination at issue.
- In the letter, the states expressed concern over the total amount of consideration 3M has agreed to pay and the time frame for the payments. The states assert that the amount, between $10.5 and $12.5 billion, does not adequately compensate the harm 3M’s products allegedly caused public water systems. Furthermore, the AGs contend that the 12-year payment plan, concluding in 2036, increases the risk that 3M will face insolvency before it fulfills its payment obligation.
- As previously reported, Arizona, California, District of Columbia, Pennsylvania, and Wisconsin AGs filed a similar amicus letter with the district court handling a proposed class action settlement between public water providers and DuPont de Nemours, Inc. arguing that the $1.185 billion settlement falls far short of the amount needed to address the harm that DuPont’s products have allegedly caused to the public water systems.
