Forever Chemical Lawsuit Brought by Tennessee AG

  • Tennessee AG Jonathan Skrmetti brought a lawsuit against a number of manufacturers of per- and polyfluoroalkyl (PFAS) substances, alleging that the manufacturers knew but concealed that their products would harm the environment and cause health risks to Tennessee residents. AG Skrmetti seeks injunctive and monetary relief.
  • The manufacturers at issue created aqueous film-forming foam (AFFF) containing PFAS, which is a product that is used in emergency response and firefighting scenarios, as well as in military and industrial facilities, airports, and other locations. The AG’s Office alleges that, in addition to possibly concealing the harm caused by the AFFF products, the manufacturers may have also fraudulently transferred assets to protect themselves from liability.
