Nebraska AG Settles Delta-8 Lawsuits Against Four Retailers

  • Nebraska AG Mike Hilgers has announced four additional settlements in a series of lawsuits filed against retailers for allegedly selling mislabeled and harmful products containing synthetic THC in violation of Nebraska’s consumer protection laws.
  • The complaints against retailers Greenhouse Grandma LLC, A Botanical Dream, LLC, First Stop Vape Shop, and Zy Glam, LLC each alleged they sold products containing Delta-8 and other synthetic THC that pose serious health risks to consumers, particularly children, because the products mimic food that is regularly marketed to children and may lead to their inadvertent consumption of THC-containing products.
  • According to the AG’s office, the settlement agreements require the retailers to stop selling products containing or adulterated by synthetic THC and turn over all remaining products to the state for destruction. The settlements also reportedly require the retailers to pay significant financial penalties in the event they breach the agreement.
  • The FTC and the FDA recently sent cease-and-desist letters to companies selling edible THC-containing products requesting that they cease marketing products that mimic snack foods appealing to children.
