- West Virginia AG Patrick Morrisey and Kentucky AG Russell Coleman co-led a coalition 26 Republican AGs in challenging the National Highway Traffic Safety Administration’s Corporate Average Fuel Economy Standards for Passenger Cars and Light Trucks for Model Years 2027 and Beyond and Fuel Efficiency Standards for Heavy-Duty Pickup Trucks and Vans for Model Years 2030 and Beyond final rule, which sets Corporate Average Fuel Economy (“CAFE”) standards for certain vehicles.
- In the coalition’s Petition for Review filed with the U.S. Court of Appeals for the Sixth Circuit, the AGs argue that, if the court reviews the agency action, they will show that the NHTSA’s rule, which sets CAFE standards for certain model years of passenger cars, vans, and light and heavy-duty trucks, exceeds the agency’s statutory authority and is otherwise arbitrary, capricious, an abuse of discretion, and not in accordance with law.
- The AGs request that the Court of Appeals declare the final rule unlawful and vacate the Deputy Administrator’s final action.
