- Arizona Attorney General Kris Mayes sued FCA US LLC (d/b/a Fiat Chrysler Automobiles) and Cummins, Inc. (Cummins) alleging that the engine and vehicle manufacturers violated Arizona consumer protection laws by installing illegal defeat devices to bypass vehicle emissions control equipment in diesel engines on certain RAM pickup trucks, leading to excess emissions.
- As alleged in the complaint, filed by private counsel hired to represent the AG’s office, Cummins and FCA marketed and sold the trucks at higher prices with promises that consumers were purchasing “super clean” diesel technology when, in reality, the vehicles included illegal emissions control defeat devices and did not comply with EPA emissions and certification requirements.
- The lawsuit seeks civil penalties, injunctive relief, restitution, disgorgement, and other relief.
- California AG Rob Bonta reached a settlement with Cummins earlier this year to resolve similar allegations, requiring the company to pay $33 million in civil penalties and $175 million to the California Air Resources Board to fund emissions mitigation efforts. Cummins also agreed to pay $1.642 billion in a concurrently filed settlement with the U.S. government.
