Democratic AGs File Amicus Supporting FTC’s Rule Targeting Auto Retail Scams

  • A group of 19 Democratic AGs filed an amicus brief to the U.S. Court of Appeals for the Fifth Circuit in support of the FTC and urging the court to deny the Petition for Review of the National and Texas Automobile Dealers Associations challenging the FTC’s Combating Auto Retail Scams Trade Regulation Rule (CARS Rule).
  • In their brief, the states argue that the CARS Rule offers the needed specificity that current laws lack to address certain unfair and deceptive practices in the automobile sales industry, including bait-and-switch schemes and hidden-fees practices.
  • The AGs ask the court to deny the Petition and allow the CARS Rule to take effect.
