Democratic AGs File Lawsuit Asking Court to Muzzle DOGE

  • A group of 14 Democratic AGs filed a lawsuit in federal court challenging the delegation of executive authority to the Department of Government Efficiency (DOGE).
  • The lawsuit alleges that DOGE violates separation of powers principles and the Appointments Clause, and that its directives lack legal authority. The AGs seek declaratory and injunctive relief finding DOGE’s actions unconstitutional, nullifying DOGE’s executive actions, and prohibiting it from issuing orders to federal agencies, among other relief.
  • The court denied the AGs’ request for a temporary restraining order, concluding that the states’ allegations of extreme financial and programmatic harm if DOGE withholds federal funding and eliminates departments are too uncertain to show imminent, irreparable harm. The court’s order directs the AGs to decide whether they will move for a preliminary injunction.
