- The FTC and the FDA teamed up to send cease-and-desist letters to six companies alleging that their marketing of edible products containing Delta-8 tetrahydrocannabinol (THC) may violate Section 5 of the FTC Act because the packaging misleadingly imitates non-THC products that children regularly consume.
- Letters were sent to Delta Munchies LLC; Exclusive Hemp Farms and Etienne-DuBois, LLC/Oshipt; North Carolina Hemp Exchange, LLC, d/b/a NC Hemp Shoppe; Smoke, LLC, a/k/a Dr. S, LLC; Nikte’s Wholesale, LLC; and The Haunted Vapor Room. The letters detail the ways in which the companies’ THC products inappropriately mimic snack foods that appeal to children. For example, NC Hemp Shoppe sells its “Stoner Patch Watermelon Gummies” in packaging that is extremely similar to that of Sour Patch Kids Watermelon Bites.
- The letters demand that the companies cease the aforementioned marketing practices, review marketing practices for all of their products, and notify the FTC of actions they will take to address the concerns laid out in the letters.
