FTC Presses Pause on Alleged E-Commerce Business Opportunity Scheme

  • The FTC secured a temporary restraining order and other relief against Click Profit, LLC and related entities arising from allegations that the companies operate an e-commerce business opportunity scheme in violation of federal laws.
  • The complaint alleges that the companies run an e-commerce business opportunity scheme and market their scheme by making false or misleading claims, including that consumers will earn substantial income; that they are affiliated with name brand companies; and that they employ proprietary technology to ensure demand and profitability. The FTC seeks temporary, preliminary, and permanent injunctions, monetary relief, an asset freeze, appointment of a receiver, and immediate access to Click Profit’s business premises, among other relief.
  • The court’s order grants the FTC’s request for a temporary restraining order prohibiting the companies from making false claims, misrepresentations, or releasing customer information; requires them to make financial disclosures, preserve records, and report new business activity; freezes assets; appoints a receiver; and orders expedited discovery.
