New Mexico Snaps at Snapchat for Allegedly Failing to Protect Minors

  • New Mexico AG Raúl Torrez has filed a lawsuit against Snap Inc., accusing Snapchat of facilitating child sexual exploitation and sextortion through its design features and recommendation algorithms, allegedly violating state consumer protection laws.
  • The complaint claims that Snapchat’s “disappearing” content feature misleads users, allowing predators to permanently capture explicit content, which is then circulated and sold. It further alleges that Snapchat’s deceptive design, algorithms, and policies fail to protect minors, facilitate the trafficking of children, guns, and drugs, and mislead the public regarding the platform’s safety measures.
  • The lawsuit seeks declaratory and injunctive relief, civil penalties, disgorgement, and reimbursement of costs and fees, among other remedies.
  • We recently reported on a bipartisan coalition of AGs filing an amicus brief in Doe v. Snap, Inc., urging the U.S. Supreme Court to rule that platforms like Snapchat can be held liable under Section 230 of the Communications Decency Act.
