- Pennsylvania AG Michelle Henry announced that six additional states have joined a lawsuit against lending company Mariner Finance, LLC, which was first filed by Pennsylvania and five other AGs in 2022. The bipartisan coalition of 12 AGs alleges that Mariner charged consumers for hidden add-on products without disclosing these costs and fees in violation of the Consumer Financial Protection Act of 2010 (CFPA) and state consumer protection laws.
- In the Second Amended Complaint, the AGs allege that Mariner added products to consumer accounts without mentioning such add-ons to consumers and misrepresented the nature or cost of the add-ons, and engaged in predatory sales tactics such as issuing unsolicited “live checks” to consumers.
- The AGs seek full restitution for all borrowers affected by unlawful practices, disgorgement of unlawfully gained profits, rescission or reformation of all contracts or loan agreements obtained through unlawful practices, and injunctive relief to stop harmful practices, among other relief.
- Mariner responded to this story noting that it disputes these allegations and asserting that other regulators have investigated and declined to take action.
